Subject: Official Board Update on Petition & Ensuring Accurate Information-West Winds HOA
Dear West Winds Homeowners,
Thank you for your continued support and engagement. We truly appreciate the questions, feedback, and information so many of you have shared—it has played an important role in supporting transparency and accuracy throughout this process.
Why a Petition to Remove the Board?
The Board recently received a member petition demanding that the HOA Board “Call a Special Meeting of Members” to “Remove the Current Board of Directors and Elect Replacements.” The petition did not include any reasons or explanation as to why removal was being sought.
As part of its fiduciary responsibilities, the Board consulted with legal counsel and reviewed the petition to ensure that all actions taken comply with the Association’s Bylaws and Montana law. During this review, the Board identified several procedural and factual irregularities that raised concerns about the petition’s validity. However, rather than challenge or discard it, the Board elected to verify each submitted signature and move forward in good faith to ensure members’ rights were respected and due process was upheld.
In accordance with the Association’s Bylaws, Section 3.2, and Montana Code § 35-2-527, a valid petition must be signed by ten percent (10%) of the voting power that is eligible to vote (42 of 412 lots), state its purpose, and be verified by the Board.
The Board completed the required verification and determined that the petition met the minimum threshold needed to call a Special Meeting. As required, on October 15, 2025, the Board subsequently issued the official Notice of Special Meeting and Election information (voting to remove or retain the current board) via email and mail.
Fact vs Myth – The Truth Matters
In recent weeks, the Board has also received verified reports that some individuals associated with the petition have circulated false or misleading information about the HOA or its Board members through various channels, including door-to-door conversations, meetings, emails, mailings, printed materials, and social media.
Misinformation can create costly & harmful confusion, division, and misunderstandings about HOA operations. To help ensure all homeowners have access to accurate and verifiable information, the Board will begin sharing a series of Fact vs. Myth Updates via email and the HOA website. These updates will reference verified records, governing documents, and applicable Montana law.

Protecting the Community’s Integrity
The Board also reminds members that unauthorized use of the HOA’s name, logo, or materials, especially in ways that misrepresent the Association, is strictly prohibited. Similarly, interference with official HOA vendors or projects disrupts operations, delays maintenance, and increases administrative and legal costs for all homeowners.
We sincerely appreciate the homeowners and vendors who have shared concerns, forwarded documentation, or reported incidents. Your engagement has strengthened transparency, accountability, and responsible governance throughout this process.

The Board extends its sincere gratitude to all homeowners who have reached out with support, constructive questions, and helpful documentation. Your involvement has been essential in maintaining and fostering accuracy, transparency, and accountability.
We share a collective responsibility to maintain a respectful, cooperative neighborhood built on accurate information and mutual respect. The Board—composed entirely of unpaid volunteers—values homeowner participation and welcomes constructive dialogue through appropriate and official channels, including Board meetings, formal correspondence, and verified HOA email addresses.
We encourage all members to rely on official HOA communications for accurate information and to verify any claims directly with the Association before sharing them.
